By accessing or using vakay ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and vakay.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.

You must be at least 18 years old and have the legal capacity to enter into contracts to use vakay. By using the Platform, you represent and warrant that you meet these requirements.

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Booking Process

vakay acts as an intermediary connecting you with hotel partners. When you make a booking through our Platform:

• You enter into a direct contract with the hotel or accommodation provider for the stay itself.
• We facilitate the booking process, including rate searches, reservation confirmations, and payment processing.
• Hotel availability, pricing, and room details are provided by our data partners and may change without notice.

Pricing and Payments

• All prices are displayed in the currency you select and include applicable taxes and fees unless otherwise noted.
• Prices are subject to availability and may change between the time you search and the time you confirm your booking.
• Payment is processed at the time of booking or at check-in, depending on the hotel's policy.
• You are responsible for ensuring your payment method is valid and has sufficient funds.

Cancellations and Refunds

• Cancellation policies vary by hotel and rate type. Refundable and non-refundable rates are clearly indicated during the booking process.
• Cancellation requests must be made through the vakay platform within the applicable cancellation window.
• Refunds, where applicable, will be processed to the original payment method and may take 5-10 business days to appear.
• No-shows or early departures may result in charges as determined by the hotel's policy.

Registered members may access exclusive pricing on select hotels. Member pricing is subject to the following conditions:

• Member rates are available only to users with a valid vakay account
• Discounts vary by property and are applied automatically at checkout
• Member pricing cannot be combined with other promotions unless stated
• We reserve the right to modify or discontinue the member pricing program

You agree not to:

• Use the Platform for any unlawful purpose
• Make fraudulent bookings or provide false information
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to extract data from the Platform
• Interfere with or disrupt the Platform's functionality
• Resell or commercially exploit bookings made through vakay
• Post false reviews or misleading content

All content on the Platform, including text, graphics, logos, images, software, and the overall design, is the property of vakay or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Platform without prior written permission.

The Platform may contain links to or content from third-party websites and services, including hotel descriptions, images, and reviews provided by our data partners. We do not endorse or assume responsibility for any third-party content, products, or services.

Hotel descriptions, photos, and amenity information are sourced from third-party providers and may not always reflect current conditions. We recommend contacting the hotel directly to confirm specific details before your stay.

To the maximum extent permitted by law:

• vakay provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied.
• We do not guarantee that the Platform will be uninterrupted, error-free, or free from harmful components.
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform or inability to use it.
• Our total liability for any claim related to the Platform shall not exceed the amount you paid to vakay in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless vakay, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any booking or transaction you make through the Platform

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules. Before initiating arbitration, you agree to attempt to resolve the dispute informally by contacting us.

You agree to waive your right to participate in class action lawsuits or class-wide arbitration against vakay.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which vakay operates, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
